no doubt whether you are of faith or not, but for that mother today, her prayers were answered. we're live in san jose, i'm damien tra hujillo, nbc news. relief for the police who reached that little girl in the suv. he's sharing his story. officer acosta shared his reaction when he found her. >> she appeared like an 11-month-old would. she appeared distraught, kind of lost r lost, dazed. so she was happy to see us. >> officer acosta even rode with the little girl to the hospital and stayed there until she was reunited with his mother. the experience was emotional for him as well as the father of a 6-year-old and 2-year-old children. a castro valley man is now dead after being shot by police last week. investigators say terrence barry

called the alameda sheriff's office friday, told dispatchers he was going to shoot up the world. he also told them he had a machine gun. deputies arrived in an armored vehicle and spied barry in the bushes. at that point barry pointed what they thought was an assault rifle at them. they opened fire. after, the investigators learned it was only a homemade replica weapon. barry was hit twice and died at the hospital yesterday. her family calls her their shining star, but most of the world knew her as 19 year-old lance corporal. she was one of two killed last week. here in the bay area where she grew up, her family is mourning her loss and remembering her amazing spirit. the marine's sister spoke today. what a tragic loss for that family, jodi. >> very tragic, jessica. the young marine from oakley had a lot of dreams, and she was proving she could make those

dreams come true. tonight her family is heartbroken that their pride and joy is gone. >> she was a very positive person, brave, the most brave woman i ever met. >> reporter: but the family of 19-year-old lance corporal sara castomata can't believe the place they assumed she was safe is where she lost her life. military officials say castomata and another marine was shot and killed by marine savio lopez at a military base in quantico, virginia. >> i wouldn't think, oh, my gosh, my sister is in danger. she's in afghanistan, she's in iran, but she wasn't. she was working at the base in quantico, and -- >> reporter: castamato's sister said the loss to her family is devastating. she was the youngest of three sisters, the shining star of the

family who was determined to be an independent woman. in fact, she joined the marines to pay her way through college and prove she was tough. >> she told me, i'm tough so i want to do that. >> reporter: making it through boot camp isn't the only challenge castomata overcame. she moved to the base area from mexico at nine years old, not g knowing any english, yet she excelled right away. >> she learned english in less than six months. she was very smart, even better than the kids who were born here. she was getting good grades. >> reporter: that's what her family is focused on tonight. her sister said she doesn't want to think about what may have been behind the shooting, choosing instead to remember the joy and pride her sister has brought. >> i don't want to know. i just want to know that, you know, she didn't suffer and she went in peace and she's with god

now, and she's an angel. that's all i want to know. >> reporter: the young marine's parents hope to fly to virginia sometime this week to bring their daughter back here to oakley. her sister said as much as she is hurting, she knows her parents are a hundred times more heartbroken that their youngest, their baby, is no longer here. reporting live in oakley, i'm jodi hernandez, nbc bay area news. it appears hundreds of people answered the call to turn in hundreds of guns in gang colors in santa clara county this weekend. 610 firearms were collected at a gun buy-back event on saturday, 17 of them assault weapons. in return, more than $61,000 was paid out. but 150 gang-related items were also collected including knives and gang-colored bandanas. a similar event this month netted a thousand firearms. a transient arrested in

connection with the death of an elderly news vendor in san francisco will be charnld with his murder after all. 77-year-old donald ayers was on break when he was attacked. mark anthony cassell walked up to him and slammed him onto the pavement for no apparent reason. the fall shattered ayers' hip and he died three weeks later in the hospital. cassell was charged with one count of murder and also will be charged with an additional count of elder abuse. the da said he didn't have enough evidence to charge him with more, but bail is set at half a million dollars. there's word tonight that san jose is about to spend big so that tech giants continue thinking the golden state instead of the lone star state. it appears the city is prepared to spend millions to make sure that happens. we're outside to explain san jose's, shall we call it, an incentive plan? >> reporter: that's what we're calling it tonight, jessica, and it certainly seems you have to give to get is the philosophy

the city of san jose is falling, and trying to make sure samsung stays and grows here in the silicon valley rather than doing that in texas. take a look at what they are preparing to offer to samsung. a $3.9 million reduction in the traffic impact fee, a 2.6 million utility tax rebate and half a million dollars in tax refunds. they have a better business climate and no income tax. the silicon valley giant is committed to growing its current 200,000-square-foot facility with its many employees to the new facility which will be 700,000 square feet, and with that additional space will come about a third more workers. san jose mayor chuck reed says the tax breaks will eventually mean more tax breaks for the city, though the tax association says it's not a fair way to do business. >> we will get about $25 million

in additional revenues for the city of san jose in a variety of taxes, and it will give up about 7 million of that over ten years to help keep samsung here. >> reporter: we talked about the ceo of another company, bestronics, which just moved into a manufacturing facility, but without tax ensent tiincent the city. he doesn't be grudge that they got a break because it means a healthier economy for everyone. the city council is expected to vote on that slate of offerings for samsung, but at least out here on 1st street in san jose, it looks like they are ready to grow. nbc bay area news. do not disturb. still ahead at 6:00, a change of heart over a piece of art. the piece of history won't be checking out of the hotel after all, but its new home still up in the air. we'll explain.

when you get up in the morning, it is there. >> reporter: but the political road to the building of the tunnels wasn't always a smooth one. caltran originally envisioned a bypass through the mountain. >> the plan for 50 years was to build a big highway bypass through the mountain, and the plan was to have a highway going to san obispo. >> reporter: the plan called for a local initiative for the tunnels. >> the city really came out and voice third opinion that opposed to a bypass, a tunnel was really the best alternative and that's how we ended up where we are tomorrow. >> they include state of the art systems like exhaust fans, which got some work today thanks to all the classic cars. they're expected to open to the public later tonight or early tomorrow morning, and know their name for the u.s. representative todd lantos, slater carter has

her own name for them. >> i think it truly is slater's tunnel in that regard. >> put your cash away. the bridge will have a new electronic tolling system in just two days. bridge workers made last-minute changes to make sure drivers are good to go on thursday morning. bridge employees will stand at the toll booths to wave traffic through. then a sign will read, do not stop. automatic tolling. well, a service dog can be a lifeline for its owner. archie is an anxiety dog and he went missing five days ago. today police received an anonymous tip, an address where archie had been seen. they went there, found archie, checked his microchip. the owner said her pomeranian was recovered six hours after getting that tip, but the five days waiting were extremely difficult for her. >> he's my service animal, and he's everything. you know, he goes everywhere with me, so it was just

completely devastating and a living nightmare. >> nightmare no more, though. he was reunited with his owner this afternoon. police, though, are still investigating his theft. the coast guard are suspending their search for a 22-year-old man who received from roosevelt beach on half moon bay. carlos javier lopez seen here on the right finished work at a local restaurant before joining friends on the beach sunday afternoon. he went in for a swim about 2:00. friends lost sight of him. the coast guard spent the afternoon and evening searching by water and by air with help from the service department. despite the warm air, the water is still very cold and there are dangerously strong currents all along the coast. it's a done deal. u.s. regulators have approved nasdaq's plan to confirm trades they were unable to make when the firm went public. firms have one week to submit requests. many traders lost money on may 18 of last year because of a

technical glitch which prevented timely order confirmations. by some accounts, wall street firms lost as much as $500 million because of the botch botched ipo. yahoo bought up a some software. the terms of the deal not disclosed, but the technology blog said he will pay $39 million. they will review how things like news, weather and stocks are delivered on mobile devices. in san francisco, the outcrycomplaints were just too much. its famed artwork, the pied piper, will not be checking out after all. they decided to auction off a large mural which has hung over the hotel bar for more than 100 yea years. painted by famed maxfield

parrish to celebrate the opening of the hotel after the earthquake. they now have plans to sell it. almost immediately, critics and fans of the mural, including san francisco mayor italy, complained. they said the pied piper will return after getting restored, but maybe they'll move it to a different roomment. let's check the forecast right now, ed, see what's going on. i know there was some rain in the forecast. is it still there and how much? >> we're still looking at a few of these showers lingering, you guys, as we head through a lot of this week. it's going to be one of those weeks where you're out and about, it's dry, you get a few showers and things dry out again. more nuisance activity this week than very disruptive weather. winds in new england, 20 miles per hour. that has dropped temperatures notably up in the north bay. anywhere from 10 to 15 degrees back to the east bay. 56 in concord, 56 in san francisco, but look at this. down here in the extreme south

bay, this is not a typo. gilmore did have a high of 74 degrees shelt erd by the offshore wind. those numbers were sheltered in san maarten. we are starting to see the current temperatures drop in the north bay. lovato at 72. close to the 40s in walnut creek with 53 and currently 53 in hayward. let's get you outside to the live sky watch network and you can see the cloud cover overhead in san jose. with our storm system to the north, it's a mix of clouds on the cold front and the offshore flow. they'll take a few inches of rainfall before our rain season is done. hopefully we'll get it. it's been such a dry 2013, so banking on potentially more storms here in the coming month. and from san bernardino mountain to san francisco, we'll have the fog on the coast, and eventually that fog is going to stream to the bay area in the next 24 hours as well. active pattern this week.

what we have happening is the jet stream will move more to the south than we've seen in quite some time with a more consistent motion. it's a much weaker system offshore. that's going to be pushing off. the one we're a little more concerned about would be for this weekend, not because it's a strong storm but the ramifications of the different paths it may take. there is a wetter storm track that could take it here from friday to sunday off to the north and also a dryer one that would bring it more off to the south. the wetter storm track at the worst would produce a tenth of an inch to maybe half an inch of rainfall, and the dryer track would mean mainly some sun, clouds, maybe some isolated showers but no huge accumulations. at this point most of the forecast models have been consistent with the dryer storm track down to the south. so from friday to sunday, we're going to keep showers in the forecast, but it just does not look like a big storm at this point. let's bring you back into the next 24 hours. getting up early tomorrow morning, taking the kids to school, we'll have a cloud cover, temperatures in the 40s.

filtered sunshine in the afternoon hours. on that four-day forecast, we'll keep a chance of showers here wednesday and also thursday. about a 40% chance at this point. just because we have the time tonight and it's monday, we're going to take a look here across the sierra. ski resorts, the numbers are dwindling. snow bases anywhere from 10 to 48 inches. the sierra notisnowpack at the central region is 59% of normal. it's still all right, but we're definitely hoping for some more rain and snow the next month or so, guys. >> thank you very much. they may be temporary tattoos, but they can have longlasting effects. the serious health problems linked to the fashionable trend. how the tech giant is upping the ante in the mobile max war. the jail transfer that has some outraged. we're back in two minutes.

california's roads are so full of potholes it's now costing california drivers nearly $14 billion a year to fix the damage done to their cars. that works out to about $586 per driver. the american society of civil engineers tells the l.a. times nearly 70% of california's roads are in poor or mediocre shape. at least we're not alone, though. washington and oregon's numbers are almost as bad. about 65% of their roads need work. the three men under arrest after police pushed them to the east bay may be responsible for two shootings. they spotted a driver driving a car erratically near terrell and t tennyson around 11:00 last night. police chased that car for

nearly 20 miles until they crashed near oakland. police say it's possible the driver was under the influence of drugs or alcohol. they say the suspects may be linked to another shooting on sunday and another in san leandro on friday. the plan to move 60 roommates from the overcrowded facility to dublin is drawing criticism from the aclu. the aclu says the transfer is a waste of resources and will do nothing to improve public safety. the group says monterrey should be working on ways to rehabilitate the lower risk inmates rather than shuttling them to other cells in other counties. the inmates have access to anti-recividist services that others don't. it needs a total overhaul before it falls apart. it also says in addition to being outdated, the parks department isn't generating the revenue it needs to sustain

itself. officers want a thorough assessment of the 280 parks. we should note the study was done before recent revelations that the parks department had hidden more than $50 million in funds. the city of stockton in federal bankruptcy court this week with one-fourth of its population living in poverty. forbes magazine last year named it the most miserable city in the united states. stockton was slammed hard when the real estate bubble burst which flooded the market with foreclosures and sent housing prices down by 70%. they will try to determine if the city negotiated with its creditors in good faith before filing for chapter 9 protection. the creditors stand to recover more of their money if the city does not declare bankruptcy. u.s. lawmakers ripped the nra with what the organization is accused of doing in the wake of the newtown shooting. an exclusive jailhouse interview with jerry sandusky. his side of the story and the one witness he says got it wrong. plus --

less than 24 hours from now, those for and against same-sex marriage will be arguing before the highest court in the land. tomorrow's supreme court hearing on california's voter approved ban on same-sex marriage has been a long time in coming. >> medicolegal experts predict it will be a roe versus wade moment for the lgb community, but both sides planning demonstrations. nbc's cheryl heard joining us from the decastro district where the planning is just getting under way. >> as you can see, the crowd here in decastro is growing. people are here from all over l.a. and all over the country.

both sides of this issue are preparing to hear arguments at the u.s. supreme court. brian willingham and his husband alfonzo garcia were legally married in new york and now live in irenda. the ira wants to report garcia because their marriage is not recognized. >> because of the defenseive act, they pretend we don't exist so they treat us like strangers. >> reporter: what many are treating as the gay rights civil movement, they're being planned. in washington, d.c., people are lined up outside hoping to get a seat inside to hear tomorrow's oral arguments. meanwhile, in the court of public opinion, polls increasingly show a majority of americans now support same-sex marriage, but the idea still has some strong opposition. >> marriage laws are designed to

attach mothers and fathers to each other and to the children that they may create and raise in the best environment. >> reporter: in san francisco, it is clear there is overwhelming support for marriage equality. tonight, same-sex marriage supporters will be in a march from decastro to city hall. >> it seems like people are lining up and that people want to be on the right side of history. >> reporter: the rainbow flag will fly in front of berkeley city hall while the supreme court justices hear the two cases. >> i don't think the purpose of flying the flag in oakland, berkeley or san leandro is to try to change the supreme court's mind, it's to give encouragement and support to people who believe in marriage equality. >> reporter: as you can see, this line is growing. it's going from here to market down castro, and there is a number of people on the other sidelining up down market street. now, they will take their demonstration down to san francisco city hall. organizers expect about a thousand people to show up.

they are not really sure if they'll get that number, but that's what they expect. a number of vigils will take place tomorrow and on wednesday. reporting live in san francisco, i'm cheryl heard, nbc bay area news. the same-sex marriage hearing is turning this week's supreme court arguments into a spectator sport complete with high ticket costs. there are 250 seats that are free to the public, but since they're first come, first served, some have paid stand-ins to keep their spot until thursday at up to $6,000 a seat. by comparison, the best superbowl ticket, $1200. the hottest broadway show, less than 300. but they say the expense is worth it to watch history being made. and you can go to the front page of nbcbayarea.com for the latest updates on tomorrow's supreme court arguments. we'll also be posting complete audio from the hearing. that's nbcbayarea.com.

president obama hosted a naturalization ceremony at the white house this morning just as the debate over immigration is heating up again. the oath of allegiance was administered by secretary of homeland security janet napolitano to 28 candidates, including 13 members of the armed services. >> we've known for years that our immigration system is broken, that we're not doing enough to harness the talent and in genuity of all those who wan to work hard and find a place here in america. the time has come to fix it once and for all. >> both senate and house lawmakers are expected to finish it up in april. they decide tomorrow whether amanda knox should be retried for the 2007 murder of her roommate. knox and her boyfriend spent four years in jail for the murder of meredith kircher. kircher was found with her throat slashed in the apartment she shared with knox.

the case was acquitted after evidence found in the case to be contaminated. the italian court was to decide today, but the arguments ran long and now that decision is expected tomorrow. we're hearing a different side of the sex abuse scandal involving former penn state football coach jerry sandusky: his own. the "today" show spoke to sandusky in jail. he commented on the testimony of mark mcqueacqueary, one of the prosecution's witnesses. >> i think these investigators, the way they went about business. his story changed a lot. >> this has been a rush to judgment from the very beginning, and i know i'm going to get attacked from everybody because no one wants the truth now. >> filmmaker joe zigler said he's trying to prove that head

coach gentleman paterno had nothing to do with the scandal and he should not have been chased from the school in disgrace. secretary of state john kerry and karzai met today. nbc's mike taibi reports in kabul. >> reporter: the u.s.-run facility which today was handed over to afghan control, the afghans will have complete authority at this point. >> we're very comfortable that the sovereignty is fully protected and the interests of the united states with respect to prisoners are fully protected. >> reporter: mr. karzai will make the decisions promising he will consult with the u.s. about any prisoners considered to be high risk or potentially dangerous prisoners. there was discussion during the press conference about the coming afghan elections in april of 2014. secretary kerry was saying that he is satisfied that karzai and afghanistan are on the way to safe, secure and transparent

elections. there were discussions about security issues which remain huge in this country. they discussed the withdrawal which is beginning right now of u.s. forces just west of kabul where there has been a lot of violence and accusations flying back and forth about whether or not u.s. and coalition forces have been involved in harassments and worse. there was a lot of tension in the past couple weeks about karzai's recent criticism, his allegation that the u.s. was working in concert with the taliban against afghan interests. >> now, the media took that to say that i said there is a collusion. i never used the word collusion between the taliban and the u.s. those were not my words. >> reporter: karzai said his comments were misinterpreted. kerry said he understood. the two men not necessarily old friends but certainly old acquaintances a together and a to be friendly and, as kerry sa said, on the same page today.

the national rifle association is under fire tonight. people in newtown, connecticut say they've been receiving automated calls from the nra urging them to oppose gun control legislation. several residents say they're outraged. they say the calls are insensitive, especially so soon after the december shooting rampage at sandy hook elementary school. that rampage killed 26 students and educators. the robo calls began last week. like many states, connecticut is considering stricter gun control measures in the wake of that shooting. the rising cost of babysitting. where the bay area ranks in a new survey. plus moms may be making the switch a little too soon. the important warning for parents of young babies. giants fans, the unique new offering at at&t that could leave you cheering. good evening. i'm jeff neary in the weather center. your forecast tomorrow with that storm system will be delivering

temporary tattoos may be more permanent than you think. today the food and drug administration said henna tattoos may not be safe. henna dye is made from henna leaves which are red dish brown. the traditional henna at that times last 7 to 10 days, but some temporary tattoo artists

are adding hair dye to make them last longer. the so-called black henna can be bad for your skin. they've reported redness, bl blisters, and welts and some have reported permanent scarring with these. a recommendation from the cdc found too many mothers give their babies infant cereal before they're four months old. experts believe babies should not have any solid food until at least four to six months. mothers surveyed said their babies seemed hungry so they thought extra food would help them sleep longer at night. experts say starting solid foods too early can increase the risk for chronic diseases. when you take a break from junior, how much do you pay the sitter? san francisco baby sirts are paid more than their counterparts in any other u.s. city. the average rate for a sitter in the bay area is $14 an hour. that's for one child. that's 50 cents more than parents in new york city pay.

the latest battleground between google and apple could be indoor maps. that's the conclusion the "new york times" is drawing after apple's acquisition of a company called wi-fi slam. the startup allows users to pinpoint their exact location inside a building using wi-fi rather than gps technology. google is pouring resources into a similar indoor maps initiative. they want to make it easier to find stores and bathrooms inside shopping malls, airports, large department stores and transit stations. experts say wi-fi slam technology could allow apple to get ahead after what many call early mapping failures. the nation's fourth largest cell phone carriers ready to do

something different in hopes of attracting new customers. t-mobile usa want to use what's called an installment plan. they're expected to be something between a pre-paid plan and a no contract plan, kind of a hybrid. if you're confused, you're not alone. they're planning to offer a better explanation as part of an event tomorrow. they will outline when they will start carrying apple's iphones. a change in the forecast coming up. might be a little rain, might be a little more than a little rain. jeff will tell us about that. >> a real contrast on that 7-day, but the thing you need to know is we have no major storm systems coming up in the next 7 days. it's a very light rain. we have some dry airn the lower levels here in the bay area, so it would really have a hard time touching the ground if any of that did make it to us tonight. but we're going with the best chance of some sort of sprinkles, maybe even a little

drizzle up the coast lline as w head to the next 24 hours. temperatures are dropping out here. 10 to 15 degrees cooler across the bay area as a result of that onshore wind 10 to 20 miles per hour and cooler numbers resulting in the 50s across the bay. let's get you to that sky camera network on this monday. and you can see looking back on the coastline, mat reason layer right up near the highest elevations where we had a best chance of some drizzle and a cloud cover also spreading in. san bernardino mountain pretty gusty here, winds anywhere from 20 to 30 miles per hour, so the best thing will be that wind as we head in the next 24 to 48 hours. with the wind starting to shift more on shore, the atmosphere getting stirred up and possibly a little bit of drizzle along the coastline. that allergy forecast will go

more to the lower levels than the higher lefrlz we dealt with this weekend. now the jet stream. it's going to stay poised here from the west to the east right across california. we're going to see some waves moving on in this week. very weak areas of the storm systems. they're not going to produce any kind of major rain, but as we've been saying, a chance here for some on again-off again showers. we'll find 50s and 60 as long the coastline and some rain in the next two days. widespread cloud cover for everyone. you'll be cloudy there at the silicon valley at 7:00 a.m. we'll get some filtered sunshine in the interior valleys, and then on the immediate coastline, you'll be stuck with some fog and potentially some drizzle that will linger in your afternoon hours. 45 in santa rosa, 42 in napa, 52 in oakland, 46 in redwood city.

throughout tuesday, temperatures will be real similar to what we experienced for today. 67 in morgan hills, 62 in gilroy, for the east bay a little cooler than the south bay. 61 in castro valley, 64 pleas t pleasanton. temperatures will remain in the 50s, then you go with 63 in santa rosa, 62 in san mateo. on your three-day forecast, we keep the fog on the coastline for tomorrow morning, then throughout wednesday a chance here for scattered showers mainly in the north bay, then for thursday, 43% chance of showers for everyone. then friday, saturday and on easter sunday, we'll keep a chance for on again-off again showers in the forecast. there's no realtiming for any of that because we'll have a chance for that on the coastline. shower activity, then some sun, then some clouds. the best thing is just keep that umbrella handy. >> it's all over the place.

>> it certainly is. it appears giants fans are about to get a new way to carry their wine at the game. starting this season, so-called zips cups are featuring pfetzer wine. it will be available at baseball parks nationwide, and yes, we'll be one of them. they're supposedly spillproof, so when you jump up and down to do the wave, you won't spill on anyone. it costs about $10 per drink. that could add up quick. the ballpark isn't the only place you'll see these. they are also expected to hit grocery store shelves very soon. it's like a chalice. speaking of sports, let's check in with ahmet now. do you have any of those cups in san francisco? >> we don't have any yet? i'm thinking $10 at a baseball game, actually not bad of a deal. you might have to invest in a couple. you get to take it home with you, too. we'll talk about baseball a little later in the sportscast, but still on to hardwood.

whenever the lakers are on the schedule, it's usually bad news for the doves. l.a. has beaten the golden state 42 of the times they've faced each other. henry, curry had to leave last game after rolling his ankle. what is his status for tonight? >> reporter: ahmed, we have breaking news and it's very good news for golden state warriors fans. they're star point guard stef curry will play tonight against the l.a. lakers. kobe bryant in town. a lot of fans rooting for the visiting team, but most of the fans wanted to make sure their guy was okay to play after rolling his ankle saturday night against the washington wizards. he has been extremely hot lately. curry is averaging 30 points a game in his last seven games. meanwhile the lakers are trying to bounce back after two bad losses to the phoenix sunz as a the washington wizards. earlier today, coach mark jackson was asked if his team needs to make a statement by

we've talked a lot about this, pet tragedies in transit. hundreds of animals have died, been injured or disappeared in the care of airlines. >> now investigative reporter elise kirchner reported why airlines are not reporting what occurs every time. >> reporter: there is a loophole in the law that allows airlines not to report all incidents. under the d.o.t.'s current policy, animals that are transported without an owner are just considered cargo. if you purchase an animal from a breeder and it dies in transit, the death doesn't have to be reported to the government. that's what happened to dog owner tory stroud. >> for me and other people who have lost animals this way, you never get to know what happened. there's never -- there's no resolution. they're just gone. >> reporter: and we will hear
